Terms and Conditions

Introduction

  1. WV Active is an Arm's Length Organisation of the City of Wolverhampton Council. Your agreement will be with the City of Wolverhampton Council.
  2. This agreement commences once you have paid your pro-rata payment. WV Active Membership enables you to use all three WV Active facilities (Aldersley, Bilston-Bert Williams and Central Baths), subject to the conditions of your chosen membership package.
  3. You cannot transfer this agreement to anyone else.

Minimum Age Requirements

  1. WV Active’s Standard, Corporate and Concession membership scheme is only available for customers aged 16 and over.
  2. Anyone under the age of 16 may sign up for our Pay as You Go, YO! Active or Youth Gym memberships, however the applicant is responsible for ensuring that a parent/guardian aged 16+ is responsible for undertaking the sign-up process.
  3. It is a requirement and responsibility of all customers aged 14+ to sign a Health Commitment Form prior to being given access to WV Active Facilities. If aged 14-15, it is also your responsibility to ensure that you book and attend a gym induction prior to accessing any of our gym facilities on site.
  4. In order to control unauthorised access to WV Active facilities, all customers aged 16+ will be required to have a photograph stored on their personal membership account. Customers aged 15 and under will be required to have a photograph added to their account showing their age/age category. This will be undertaken on your first visit and any child under 8 must have a parent/guardian present when they attend site.
  5. WV Active reserves the right to request proof of age from any applicant at point of sign up, or during their attendance at WV Active facilities at management discretion.

Use of WV Active Membership Card

  1. You will be issued with a card/easy band which must only be used by you. It is compulsory to have a photo ID entered onto the WV Active Membership system otherwise entry will not be permitted.
  2. The card/easy band must be produced at reception or via the fast-track systems, as well as at specified access points on each visit in order to gain access. WV Active is unable to allow access to the Facilities if you do not turn up with a valid WV Active membership card/ easy band.
  3. Should you lose or misplace your WV Active membership card or easy band, a replacement can be purchased at reception for a fee of £3 per card or £5.00 per easy band.

Payments

  1. Membership package prices are subject to change in line with WV Active’s annual pricing policy. Existing agreements will not be affected; however, amended prices apply at renewal stage.
  2. Monthly memberships are paid via Direct Debit and will continue until WV Active is notified in accordance with the cancellation policy.
  3. On applying for your Monthly Membership, you are required to make an initial payment which will depend upon the day you join.
  4. You must register your bank details to set up a direct debit instruction, please note that not all bank accounts support Direct Debits (for example some savings accounts and non-uk accounts). We do not accept cash memberships a Direct Debit must be set up in order to have a Membership with WV Active.
  5. WV Active collects Direct Debit payments on the 1st of each month.
  6. WV Active is not responsible for any fees incurred if collection dates vary. It is your responsibility to ensure that the required funds are available or risk the payment defaulting.
  7. If a Direct Debit is returned unpaid for whatever reason, we will automatically change your Direct Debit to a card payment to be paid on your next visit to our Facilities, this can be paid via contactless or you can go online to pay by logging into your account and going to “My basket”; you will not be allowed to use our Facilities until the unpaid amount has been paid.
  8. We will attempt to contact you to let you know what has happened by email, however despite us having notified you of a missed payment, if a subsequent payment is then missed, we reserve the right to terminate your membership.

Changing Your Bank Details

  1. If you are changing banks and wish to continue to pay for your Membership by Direct Debit, you need to contact your new bank and instruct them to switch all Direct Debits to your new account.

Annual Memberships

  1. An annual membership must be paid for in advance, as part of your membership application by debit card/credit card online . WV Active’s annual membership is best suited for customers who wish to use our facilities for a fixed period or customers who do not have a bank account that supports direct debits.
  2. Subject to the Cancellation policy below, if you decide to leave before the end of the fixed contract, your membership will not be refunded and cannot be froze.
  3. Should WV Active increase or decrease membership prices, your existing annual membership price will not be affected until it expires.

Freezing Memberships

  1. We allow customers to have a freeze holiday on payments if customers need a payment break due to circumstances. Customers have an option on the freeze form to freeze for one, two or three months, should you wish to freeze for any longer, then we do suggest you cancel. Once you have had a freeze holiday regardless of how long it is for, you then need to make three consecutive payments before you can have another freeze holiday.

Cancellation Policy

Cancellations within 14 days

  1. At the commencement of your Membership Package you are entitled to cancel for any reason within 14 days.
  2. If you choose to cancel within 14 days we will give you a full refund or any fees paid subject to the value of any usage (including cost of induction) being deducted from the refund.
  3. If you want to cancel within 14 days you should complete the cancellation form or email membership.wvactive@wolverhampton.gov.uk and please state that this is a 14 day cancellation (please note we do not accept letters posted or handed into the centres).

Cancellation after 14 days

1. If at any point, you wish to cancel your WV Active monthly membership, you must contact the WV Active membership team (by email membership.wvactive@wolverhampton.gov.uk or the cancellation form) (please note we do not accept letters posted or handed into the centres), giving us 30 days’ notice prior to your next Direct Debit due date.

2. However, if you fail to give us a 30 day notice prior to your next Direct Debit due date then the full payment for the next month will proceed. For example, a customer’s Direct Debit is collected by WV Active on the 1st of each month. WV Active is notified (by email or cancellation form) that the customer wishes to cancel their monthly membership on 15th. This means that the customer has not given a 30 day notice prior to their next Direct Debit due date and so, their Direct Debit for the next month will proceed. However, the customer will be able to use the facilities until the end of that month.

  1. You are not entitled to a refund of any payments paid prior to your cancellation.
  2. It is your responsibility to provide us with 30 days’ notice of your cancellation. If notice is not provided then the outstanding debt will need to be settled within 30 days or this will remain on your account for repayment should you re-join.
  3. It is your responsibility to ensure your Direct Debit payments have been stopped following your membership cancellation. We advise you retain your cancellation confirmation email , in the vent of any queries being raised.

Concessions and Corporate schemes

  1. Should you purchase a WV Active package as part of an approved concession or corporate scheme, you are agreeing to provide , proof to validate your application of the package. A full list of concession and corporate proof required can be found on our corporate and concession pages.
  2. Should you purchase a corporate rate or concession rate membership, regular proof will be required. Should you no longer be eligible for a reduced membership or do not provide proof of concession when required, you will be charged the standard membership rate of £20 per month.

Suspension of Use

  1. Any person discovered to have obtained a WV Active membership card on the basis of false or deliberately misleading statements and/or providing false documentation will have their card revoked. Refunds will not apply in such circumstances.
  2. WV Active reserves the right to refuse admission or to terminate a card holder’s activity/ session in event of behavior determined by the Facility to be unacceptable. Please refer to behavior policy.

Youth Gym Membership

  1. For 14 – 15 year olds only.
  2. To be used during youth gym times only - times allocated on the wvactive.com website.
  3. Monthly membership for either 28/30 or 31 days (depending on month joining).
  4. No Direct Debit – Cash/Card only.
  5. No cancellation required.
  6. No arrears will be accrued.
  7. No refund for non- usage.
  8. Parent/Guardian must be with Youth member every time they join to sign the consent/terms and conditions form
  9. You cannot use facilities without a parent/guardian signature and payment being made at the same time.
  10. We reserve the right to cancel junior gym sessions due to operational reasons and no refunds will be issued.

General

  1. WV Active reserves the right to close all, or part of the facilities during bank holiday periods or for essential repairs by providing reasonable notice, or in the event of severe weather conditions. WV Active membership card holders are not entitled to pro rata refunds based on such circumstances.
  2. WV Active reserves the right to operate facilities for the purpose of staging events or organised competitions by providing reasonable notice of any closures or disruption to services. WV Active Membership card holders are not entitled to pro rata refunds on such circumstances.
  3. WV Active reserves the right to make changes to this agreement and when any changes are made they will be displayed at the facilities. This agreement replaces any previous versions.
  4. Facility booking procedures apply.
  5. All members are required to wear appropriate gym clothing for working out. Suitable changes must be worn at all times while training in the gym. Clothing items such as jeans, sandals or anything that could catch in the gym are not acceptable
  6. You agree to inform us immediately of any changes to your membership details.
  7.   8. This agreement is governed by English Law.

This Hire is between you (the “Hirer”) and the City of Wolverhampton Council who will be referred to in this document hereafter as the “WV Active”. For the purpose of clarity, WV Active is wholly owned by the City of Wolverhampton Council (“the Council”) and use of WV Active include employees of the Council.

1. DEFINITIONS

In these conditions the following expressions shall be interpreted as following:
Booking Form means the form filled out by the Hirer for Events Hire Bookings or Organisation or Affiliated Club Bookings and accepted by WV Active for the Hire of the agreed area within the relevant WV Active Centre.
Facilities means the hire of the agreed area of the relevant WV Active Centre, together with any facilities of equipment hired thereto and including the non-exclusive use of dressing rooms and other accommodation attached to that agreed area.

Hire Fee means the cost payable by the Hirer for the Hire of the Facilities as set out in the Booking Form

Hire means use of the Facilities at the relevant WV Active Centre as defined in the Booking Form.

Hire Agreement means the agreement with organisations or affiliated clubs for a hire of an agreed area within a WV Active Centre for a period that is in excess of 12 months. Such Hire Agreement can be obtained by contacting a WV Active Centre.

Hirer means the person or organisation in whose name the application is made for the Hire of the Facilities

Manager means the manager for the WV Active Centre for the time being or their equivalent or his or her authorised assistant.

WV Active Centre means Central Baths Leisure Centre, Aldersley Leisure Village and Bert Williams Leisure Centre

2. APPLICATION OF HIRE

2.1       Hirers must apply for the Hire of a WV Active Centre by filling out the Booking Form.
2.2       The Hirer may apply to book the WV Active Centre using one of the three methods which are as follows:-
2.2.1    Block Booking is a regular booking made by the Hirer of 10 or more consecutive sessions in the same activity and at the same facility.  Block Bookings must be paid for in full and in advance of the first session.

2.2.2    Events Hire Booking is the hire of the Facilities for an event or events and must be made in advance. For the avoidance of doubt an Events Hire Booking is a booking which is not a Block Booking and the Hirer is not classed as an organisation, school or affiliated club.

2.2.3    Organisation, School or Affiliated Club Booking means two or more bookings in a year and made in advance for use of the Facilities. For the purpose of clarity this does not include pay as you go use of the WV Active Centre, Events Hire Booking or Block Booking customers. 

2.3       The Hirer must enter into a Hire Agreement where the above three methods do not apply, and the Hirer seeks to hire facilities at a WV Active Centre for a period that exceeds 12 months.

2.4       The Hirer will be required to complete the Booking Form which is available from the         WV Active Centres. The Booking Form should be returned duly signed by the Hirer and given completed to the Manager at least 28 days prior to the date of the Hire, unless the Hire is less than 28 days away, to which the date of return of the Booking Form will be specified by the Manager on booking. 
2.5       The person or organisation in whose name the application is made shall be deemed to be the Hirer for the purpose of these Terms and Conditions. WV Active reserves the right at any time to refuse or cancel the Hire of the WV Active Centre.

3.PAYMENT AND COSTS

Block Bookings
3.1       Where the Hire of the Facilities is deemed to be a Block Booking as defined in clause 2.2.1 above, the following payment terms apply:-
3.1.1    The full Hire Fee must be made a minimum of 14 days in advance of the commencement of the first session. Bookings made with less than 14 days of the commencement of the first session require payment at the time of booking.
3.1.2    The Hire Fee is non-refundable but one session per 10 week block may be moved at the discretion of the Manager.
3.1.3    Cheques to be made payable to “Wolverhampton City Council’ and must quote the booking reference number on back of cheque.
3.1.4    For other payment methods see reverse of invoice or request details from the staff at the WV Active Centre

Event Hire Booking:
3.2       Where the Hire of the Facilities is deemed to be an Event Hire Booking as defined in clause 2.2.2 above, the following payment terms apply:-
3.2.1 The Hirer will pay WV Active a minimum deposit of 25% of the total cost of the Hire fee within 14 days of booking. The deposit is non-refundable.
3.2.2 The balance of any outstanding amount due must be paid to WV Active on the day of the Hire event or within the terms of the invoice, whichever is sooner.
3.2.3 Cheques to be made payable to “Wolverhampton City Council’ and must quote booking reference number on back of cheque.
3.2.4 For other payment methods see reverse of invoice or request details from the staff at the WV Active Centre

Organisation, School or Club Affiliated Booking:
3.3       Where the Hire of the Facilities is deemed to be an Organisation, school or Club Affiliated Booking as defined in clause 2.2.3 above, the following payment terms apply:-
3.3.1 The Hirer will pay WV Active a minimum deposit of 25% of the total cost of the Hire fee within 14 days of booking. The deposit is non-refundable.
3.3.2 The Hire Fee must be paid to WV Active within 28 days of the invoice date. To be eligible for a VAT exemption you must meet the required regulations. These are available on request from the Manager.
3.3.3 Cheques to be made payable to “Wolverhampton City Council’ and must quote booking reference number on back of cheque.
3.3.4 For other payment methods see reverse of invoice or request details from the staff at the WV Active Centre
3.4       The fee or charge payable shall be that ruling at the time of the Hire and not at the time of the application, unless specifically agreed in writing with the Manager. The Hirer will be informed of the change in the Hire Fees and will have the right to cancel the booking without cost and without the right to make any claim against WV Active in respect of such cancellation.
3.5       WV Active reserves the right to make additional charges for activities exceeding the hire period.
3.6       The Hire Fee, unless specifically stated to the contrary, is for the use of the Facilities, and any other equipment which is required must be discussed and agreed with the Hirer and must be provide at their own cost.
3.7       The Hire Fee also covers the costs associated with heating and lighting, however there are additional charges for using additional heat and light sources due to seasonal changes and requirements. These will be discussed and agreed upon at the booking stage and applied under the direction of the Manager. And will be listed on the Booking Form. This may include the special facilities for television coverage. In explanation, this paragraph refers to the provision of standard services provided by staff and the Facilities for use when hiring. However, should the Hirer require any other specific service not normally provided, then for this Hirer must cover the cost.
3.8       WV Active reserve the right to alter fees and charges

4. HIRERS OBLIGATIONS

4.1       The Hirer must comply with the regulations relating to the Facilities and any other conditions and regulations which WV Active may from time to time enforce.
4.2       The Hirer shall comply with all reasonable requests from the Manager who shall be deemed to be the agent of WV Active in respect of the WV Active Centres and for the user there of during the period of the hire and the Hirer shall strictly observe the Facilities Emergency Action Plan which is available on request.
4.3       The Hirer must comply with the requirements of Section 12(1) of the Children and Young Persons Act 1933 regarding the safety of children and entertainment.
4.4         The Hirer must comply with his obligations under the Health and Safety at Work Act 1979, not only in respect of the Hirer’s employees (paid or volunteers) but also in respect of the employees of the WV Active and members of the public.
4.5         The Hirer shall permit WV Active, their authorised officers and employees to enter and have access to the Facilities at all times.
4.6         The Hirer must take all steps to prevent the use of any article, appliance or apparatus at any event, exhibition or performance which WV Active consider objectionable or dangerous. 
4.7         The Hirer is responsible for ensuring that all equipment brought onto the WV Active Centres, including electrical goods, are safe for use and PAT tested (evidence to be provided by the Hirer to WV Active in advance of the Hire and when otherwise requested).
4.8         Hirers must not bring to the WV Active Centres any items /substance of an inflammable or explosive character or producing an offensive smell.
4.9         The bye-laws of the Council and other statutory requirements for the time being in force for the management, use and regulation of their public swimming pools and venues must be strictly observed by the Hirer, where applicable.
4.10       The maximum number of persons to be admitted to the Facilities are not to exceed the amount as stated on the Booking Form during the period of hire and the Hirer must keep a note of the number of persons admitted and show the same on demand to the Manager.
4.11       During the period of hiring the Hirer should keep all emergency exits, gangways, passages and staircases clear of obstruction and interference therewith.

    •     The Hirer shall be responsible for:

4.12.1      The payment of the Hire Fee and other charges within the terms stated on the invoice and/or booking form.

      • In the event that the Hirer is unable to maintain good order the Manager shall have the power to remove from the WV Active Centres any person, contravening these conditions or behaving in a disorderly or indecent manner, without stating the reasons.
      • The employment of any police officer, security, fire fighters or any other persons identified by WV Active for the purpose of health and safety and at the request of the Manager.

4.12.4      The Hirer will indemnify WV Active against all proceedings, costs, claims, damages, expenses and liabilities including but not limited to any injury to any person or loss or damage to property (whether owned by the WV Active or not) arising in consequence of any negligent act or omission of the part of the Hirer.
4.12.5      The Hirer shall inform the Manager of any accident, resulting in injury no matter how minor, which occurs at the Facilities during the hire period. The Hirer shall insure against public liability risks (including member to member liability) arising out of the use of the Facilities during the period of hire and shall produce to the Manager the current insurance policy covering risks referred to, at least 14 days before the date of hiring and when otherwise requested by WV Active. The minimum cover required is £5,000,000. Failure to produce the evidence of insurance will give the Council a right to cancel the Hire without notice.
4.12.6      The Hirer will ensure a suitably trained person will be on duty and be responsible for the safety of the persons using the Facilities during the whole of the period of the hiring as deemed necessary by the Manager. The Manager reserves the right to confirm the qualifications of any training person or instructor prior to agreeing to the Hire and whilst undertaking activities the trained person shall comply, at all times, with the appropriate rules of any related governing body, including the responsibility of holding appropriate music licences.
4.13       The Hirer shall not assign, sub-let or sub-licence any part of the Facilities without prior approval of the Manager and the Facilities shall only be used for the purposes stated on the Booking Form.
4.14       Any furniture, apparatus, or appliances delivered to the Facilities by or on behalf of the Hirer must be unloaded, placed in position and removed by the Hirer or persons employed by him for such purposes, at such times as shall be agreed by the Manager and no such furniture, apparatus or appliances shall be delivered or placed in position at the Facilities without the previous consent from the Manager. Any costs relating to this clause 4.14 are to be covered by the Hirer.
4.15       No decorations are to be placed upon or additions made to the Facilities to include the structure and fixtures, without the consent of the Manager. No nails, screws or other fittings shall be driven or foxed into or any part of the WV Active Centre, but only such bills, posters, flags, emblems as may be permitted by the Manager can be displayed and only in the manner directed by the Manager.
4.16       The Facilities must be vacated by all persons visiting the Facilities for the purpose of Hire upon expiration of the hire period stated on the booking form
4.17       No right to supply refreshments of any kind whatsoever shall be deemed to be given to the Hirer or to any other person by grant of the use of the Facilities.
4.18       No intoxicating liquor shall be brought to the WV Active Centres unless agreed in writing by the Manager. General laws governing sale and provision of intoxicating liquor, on site, shall apply.
4.19       WV Active does not accept any responsibility with respect to the sales or collection of monies on behalf of the Hirer.
4.20       The Hirer during the period of hire must provide his own money takers, ticket takers, instructors and such attendants as may be thought necessary by the Manager for the proper conduct and running of the particular event together with at least two life savers where a swimming pool is hired.
4.21       Life savers shall be qualified to current RLSS lifesaving qualifications and proof of such life savers shall undertake training as required provided by the WV Active Centre.
4.22       If such qualified savers or instructors are not available, qualified facility staff must be employed at the rate appropriate in the scale of charges.
4.23       If the Facilities does not have any life savers in the activity to be undertaken available, the Manager reserves the right to cancel the engagement.
4.24       If instructors are to provide music for any event, he/she as an individual have the responsibility of either providing their own PPL licence or using pre-paid tapes.
4.25       The Hirer shall leave the Facilities in a clean and as good order and condition as at the commencement of the hire.
4.26       If default is made the Hirer shall repay to WV Active a reasonable charge for putting the Facilities in good order and condition.
4.27       The Hirer shall be responsible for and shall pay to WV Active on demand the amount of any damage done or occasioned to the Facilities or the fixtures, fittings, apparatus, furniture or other contents thereof during the use of the premises by the Hirer. The amount for such damage shall be estimated by WV Active, whose decision is final.
4.28       Any further charge becoming payable as a result of exceeding the allocated period of hire or for any other reason shall be payable within 7 days of receipt of the appropriate invoice and shall be treated as a single contract debt.
4.29       The privilege hereby granted is a personal licence only and not a lease of the WV Active Centre.
4.30       The Hirer must ensure that they and any persons attending the relevant WV Active Centre for the purpose of the Hire do not bring any glass bottles or other glass items into the WV Active Centre. Where the Hirer or any persons attending the WV Active Centre for the purpose of the Hire accidently or purposely break a glass bottle, the Hirer is responsible for all costs incurred by WV Active to clear the glass, make the site safe for use again, to rectify any damage to the Facilities as a result of the glass breaking and for any other costs WV Active incur. For the avoidance, where the Hirer or any persons attending the WV Active Centre for use of its swimming facilities for the Hire accidentally or purposely breaks a glass bottle at the pool side, the Hirer would be liable to pay to for costs to clean the pool and make the site safe for use, any damage to pool and any other costs incurred for example loss of profits for the duration of the swimming pool being closed.

5. CANCELLATION

5.1       Block Booking
5.1.1    WV Active reserves the right at any time to refuse or cancel the Hire of the Facilities for whatever reason. WV Active shall not be liable for any payment whatsoever either to the Hirer or to any other person in respect of any loss or damage in any matter arising from the cancellation of any hire of the Facilities.
5.1.2    WV Active shall not be responsible for any loss suffered by or to the Hirer or any   other person as the result of the cancellation or interruption of the hiring by WV   Active.  
5.1.3    WV Active shall not issue a refund upon instruction from the hirer that they wish to cancel their booking after payment has been received.

5.2       Events Hire Booking
5.2.1    WV Active reserves the right at any time to refuse or cancel the Hire of the Facilities for whatever reason. WV Active shall not be liable for any payment whatsoever either to the Hirer or to any other person in respect of any loss or damage in any matter arising from the cancellation of any hire of the Facilities.
5.2.2    WV Active shall not be responsible for any loss suffered by or to the Hirer or any   other person as the result of the cancellation or interruption of the hiring by WV   Active.  
5.2.3    WV Active reserves the right to charge for Full Hire of the Facilities unless 28 days advance cancellation notice has been made in writing to the WV Active Centre Management.

5.3       Organisation, School or Club Affiliated Booking
5.3.1    WV Active reserves the right at any time to refuse or cancel the Hire of the Facilities for whatever reason. WV Active shall not be liable for any payment whatsoever either to the Hirer or to any other person in respect of any loss or damage in any matter arising from the cancellation of any hire of the Facilities.
5.3.2    WV Active shall not be responsible for any loss suffered by or to the Hirer or any   other person as the result of the cancellation or interruption of the hiring by WV   Active.  
5.3.3    WV Active reserves the right to charge for Full Hire of the Facilities unless 14 days advance cancellation notice has been made in writing to the WV Active Centre Management.

6. TERMINATION

6.1       Following any breach of the forgoing conditions by the Hirer as to which the decision of the Manager shall be final, WV Active may terminate the hiring forthwith, both as to the occasion of the said breach and as to any future booking and even if the period has not expired, but the Hirer shall be liable to pay WV Active the full amount payable in respect of the hiring and the amount of any damage payable under the foregoing conditions.
6.2       Where WV Active have to terminate the Hire in accordance with clause 6.1 above as a result of clause 4.30, WV Active may, at its discretion, also refuse for the Hirer to access to any WV Active Centre for any purpose.

The Council reserves the right to amend these terms and conditions.

Hire Agreement

 

The following provides details of what you can expect from WV Active’s Swim School and includes Terms and Conditions which apply to all parents or guardians of any child attending swimming lessons.

General

  • WV Active offer swimming lessons in blocks of 10.
  • All lessons must be paid for in advance.
  • Each lesson from Ducks - Stage 7 will be 25 minutes.
  • Rookie Lifeguard will be a 40-minute lesson.
  • WV Active do not tolerate abusive or aggressive behaviour towards any staff members or other customers. Management will refuse entry and ask anyone displaying this behaviour to leave the premises.
  • If you are more than 10 minutes late after the lesson start time, you may be refused entry. This is to ensure that lessons are not disrupted. You will not be refunded for this lesson.

Payment for lessons

  • The payment for the first block of 10 lessons must be made in advance.
  • To secure a place in the next block of lessons, it is recommended that the payment is made by the end of the 9th lesson.
  • Parents/Guardians are responsible for making all payments on time.
  • If the payment is not received before the start of the 10th lesson, the automated system will remove the child from their class. There is no guarantee that a place will still be available after this point and a request will need to be made to have the child added to the waiting list.
  • Payment reminder emails are sent to the email address recorded on the WV Active’s system and these are sent at 3 weeks, 2 weeks and 1 week prior to the commencement date of the 10th lesson.
  • If payment is not received in line with the points above - WV Active will refuse entry to the lesson.
  • If a child moves from a stage 1-7 lesson to the Rookie lifeguard programme, there will be an increase in payment required.

Cancellation and Refunds

  • No refunds will be given if a learner does not attend their lesson.
  • If a learner leaves prior to the end of their 10-week block, no refunds will be given for the remaining lessons.
  • If WV Active cancels a lesson for unforeseen circumstances, there will be no charge for that lesson.
  • Parents/Guardians will be notified via email informing them of any cancellations. If a lesson is cancelled with less than 4 hours’ notice, WV Active will attempt to contact guardians by telephone.
  • To obtain a refund on medical grounds, you will need to notify WV Active that the child will be unable to attend swimming lessons and obtain a GP letter that states the condition and a date that swimming can be resumed.
  • WV Active will allow refunds if a child has completed all the stages 1-7. This can be refunded via the original payment method.

Completing Stages or Moving Lessons

  • Once a stage has been completed, WV Active will advise you of the available days and times for the next stage. If there is no availability, the lessons will be frozen, and the child added to the waiting list until a space becomes available.
  • If WV Active offer more than one alternative class for the learner to move in to, but the child is unable to attend any of them, then the child will be added to the wating list until a suitable day/time is available. No refunds will be given.
  • You can request to move your child to a different day or time and WV Active will check availability, however there is no guarantee that this will be possible.
  • You can only request to change the day/time of the lesson once during each 10-week block of lessons.

Guidance

  • WV Active provide armbands and swimming aids required for the lesson.
  • All users of the swimming pool are asked to make themselves familiar with Safe Swim Policy which includes permitted types of swimwear and can be found on the WV Active webpage.
  • It is the responsibility of the parent/guardian to inform WV Active of changes to contact details and to check their emails regularly for service changes and cancellations.
  • It is the parent/guardians’ responsibility to ensure WV Active has the most current and up to date contact information for their child. This includes contact numbers, home address and email address.
  • When a child has completed a stage, they will be given a badge slip by the Swimming Instructor. This can then be presented to reception as proof and then the guardian can discuss days/times for the next stage.
  • WV Active does not accept responsibility for any damage or loss of property left on the premises (whether being worn or left in the pool/changing rooms) or within the grounds/car park of the premises.
  • WV Active will not contact parents/guardians if there is a change of swimming instructor due to sickness or annual leave.
  • Parents/guardians are not permitted to use their mobile phones within the changing rooms or pool hall areas.
  • Children 8 years or over must use their own gender changing rooms. Changing village and family changing rooms are also available.
  • It is vital that guardians advise the swimming instructors and management of the child’s medical conditions so these can be recorded on WV Active systems - It is the parent/guardian’s responsibility to ensure that WV Active are kept updated on any changes.
